Prosecution
The Government of India penalises trafficking for commercial sexual exploitation through the Immoral Trafficking Prevention Act (ITPA), with prescribed penalty of seven years' to life imprisonment. India also prohibits bonded and forced labour through the Bonded Labour Abolition Act, the Child Labour Act, and the Juvenile Justice Act.
Indian authorities also use Sections 366(A) and 372 of the Indian Penal Code, prohibiting kidnapping and selling minors into prostitution respectively, to arrest traffickers. Penalties under these provisions are a maximum of ten years' imprisonment and a fine.
Section 366A in The Indian Penal Code
Procuration of minor girl.—Whoever, by any means whatsoever, induces any minor girl under the age of eighteen years to go from any place or to do any act with intent that such girl may be, or knowing that it is likely that she will be, forced or seduced to illicit intercourse with another person shall be punishable with imprisonment which may extend to ten years, and shall also be liable to fine.
Section 372 in The Indian Penal Code
Selling minor for purposes of prostitution, etc.—Whoever sells, lets to hire, or otherwise disposes of any 1[person under the age of eighteen years with intent that such person shall at any age be employed or used for the purpose of prostitution or illicit intercourse with any person or for any unlawful and immoral purpose, or knowing it to be likely that such person will at any age be employed or used for any such purpose, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall be liable to fine.
[Explanation I.—When a female under the age of eighteen years is sold, let for hire, or otherwise disposed of to a prostitute or to any person who keeps or manages a brothel, the person so disposing of such female shall, until the contrary is proved, be presumed to have disposed of her with the intent that she shall be used for the purpose of prostitution.
Explanation II.—For the purposes of this section “illicit intercourse” means sexual intercourse between persons not united by marriage or by any union or tie which, though not amounting to a marriage, is recognised by the personal law or custom of the community to which they belong or, where they belong to different communities, of both such communities, as constituting between them a quasi-marital relation.

NHRC ensures payment of Rs. 13 lakh relief in the case of the death of a Tamil Nadu Government woman employee after slipping into a septic tank near her office; action against the guilty officials and construction of toilets in all the Agriculture Extension Centres
New Delhi, 25th March, 2022
The intervention of the National Human Rights Commission, NHRC, India resulted in the payment of monetary relief of Rs. 13 lakh to the next of kin of a Tamil Nadu Government lady Warehouse Manager, who died on 07th December, 2020 after falling into a septic tank near an under construction building to answer call of nature as there was no toilet in her office. She was working in the Kancheepuram Agriculture Development office. The relief amount includes the service benefits of the victim and Rs. 10 lakh from Chief Minister’s Relief Fund.
The State government has informed the Commission that it has also taken action against the guilty officers besides ordering setting up of toilet facilities on a war footing at all the Agriculture Extension Centres (IAECS)/Sub Agriculture Extension Centres in various parts of the State. It is also considering appointment of the victim’s elder sister on compassionate ground.
The Commission has asked the Chief Secretary, Government of Tamil Nadu to submit the status report on the construction of restrooms in all the Agriculture Extension Centres (IAECS)/Sub Agriculture Extension Centres within 8 weeks.
The Commission had taken cognizance of the fatal incident on the basis of a complaint.

A Division Bench of Justices Manmohan and Sudhir Kumar Jain said that the expression ‘human rights’ cannot be given a narrow or pedantic view, and that non-supply of documents related to a person’s promotions would amount to human rights violation.
“In the opinion of this Court, the employees of a security establishment cannot be deprived of their fundamental and legal rights just because they work in an intelligence and security establishment. To hold so would amount to holding that those who serve in these organizations have no human rights,” the judgment stated.
The judges said that the RTI Act is a tool that allows employees and officers to air their grievances systematically and its intent is to secure access to information in order to promote transparency and accountability in the working of every public authority.
“It is said that ‘Sunlight is the best disinfectant’ and the RTI Act promotes the said concept. Consequently, both service and RTI laws ‘act like a safety valve in the society’,” the Court opined.
The Court was dealing with an appeal filed by the ED challenging an order of a single-judge passed on December 7, 2018. The single-judge refused to stay an order of the Central Information Commission (CIC) which directed the ED to provide documents related to the seniority list of lower divisional clerks (LDCs) from 1991 till date. The agency was also directed to provide copies of the proposal for promotion of the respondent LDC placed before the Departmental Promotion Committee (DPC) along with copies of minutes of meetings and a copy of the promotion/rejection order issued on the recommendations of the DPC from time to time.
The Division Bench, while issuing notice in ED's challenge, refused to stay the order. The agency then filed a Special Leave Petition (SLP) before the Supreme Court, which disposed of the petition in October 2021 with a direction to the High Court to decide the matter with respect to applicability of the RTI Act to ED.
The High Court agreed with the submission by ED’s counsel that it is an intelligence and security organisation specified in the second schedule of the RTI Act, and therefore exempt from its purview, except when the information sought concerns corruption and human rights violations.
However, it did not agree with the submission that only such information that is furnished by the exempted organization to the government pertaining to allegations of corruption and human rights violation is to be provided.
On the scope of 'human rights', it held,
"This Court is of the opinion that the expression ‘human rights’ cannot be given a narrow or pedantic meaning. It does not refer to the rights of the accused alone. Human rights have been used for a variety of purposes, from resisting torture and arbitrary incarceration to determining the end of hunger and of medial neglect. In fact, the human rights are both progressive and transformative."
The Court also noted that in the present petition, the respondent was not seeking information about any investigation or intelligence or covert operations carried out nationally or internationally and if such information was being sought, the ED was entitled to deny the information under RTI.
It also clarified that the information pertaining to proposals for promotion of third parties cannot be provided to the respondent in view of Section 11 of the RTI Act.
With these observations, the Court directed the agency to provide all the relevant documents as demanded under the RTI Act, and disposed of the petition.
While Central Government Standing Counsel (CGSC) Amit Mahajan along with advocate Dhruv Pande appeared for the Union of India, the respondent was represented by advocate Shiv Kumar.

Dropped From Yogi Cabinet, Outgoing UP Deputy Chief Minister Said This
Lucknow: BJP leader and outgoing Uttar Pradesh Deputy Chief Minister Dinesh Sharma on Friday said he will continue to strengthen the party to ensure that it emerges winner in the 2024 Lok Sabha polls.
Mr Sharma has been replaced as Deputy Chief Minister in the new BJP-led state government by another Brahmin leader, Brajesh Pathak.
He congratulated new ministers who took oath on Friday and wished, "May the double-engine government of Prime Minister Narendra Modi and UP Chief Minister Yogi Adityanath continue to work for the people of the state."
"I will continue to work for the party, and strengthen it. As a party worker, I will work to ensure that the BJP emerges victorious in the 2024 Lok Sabha elections," Mr Sharma told PTI.
Mr Sharma dismissed speculations of him being next Uttar Pradesh BJP chief.
With Swatantra Dev Singh taking oath as a cabinet minister, the post is likely to fall vacant and a new state unit chief of the party may be named, a senior UP BJP leader said.

Real Hero, said Dr. Anthony Raju
Harekala Hajabba is known for the revolution he has brought in rural education within his state. He kept part of his savings from selling oranges, to start a school in the region he came from so that the children there could get educated. Today, the school, which has grown with government support and donations from private individuals, is known as Hajabba School. He is affectionately known as ‘ Akshara Santa’ (The saint of letters) in Mangalore city.
Social activist and writer Ismath Pajeer has published a book on his life, which is titled as ‘Harekala Hajabbara Jeevana Charitre’ (Life story of Harekala Hajabba). Mangalore University has included life story of Hajjabba in its latest syllabus. The British Broadcasting Corporation published an article on him with the title “Unlettered fruit seller’s Indian education dream” in November 2012.
He is the winner of ‘Real Heroes’ award by CNN-IBN and Reliance Foundation. Kannada Prabha, a local newspaper named him their Person Of The Year.
