Supreme Court Clarification on Quashing of FIR/Chargesheet under Article 226

New Delhi, September 3, 2025

The Hon’ble Supreme Court of India has clarified an important aspect of criminal jurisprudence regarding the scope of writ jurisdiction under Article 226 of the Constitution of India.

The Court held that:

A writ petition under Article 226 may be entertained by the High Court to quash an FIR or chargesheet only till the stage when cognizance of the offence has not been taken by the competent court.

Once a judicial order taking cognizance has been passed, the jurisdiction under Article 226 ceases for the purpose of quashing.

Thereafter, the appropriate remedy lies under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, which empowers the court not only to quash the FIR or chargesheet but also to set aside the order of cognizance, provided the same is specifically challenged with requisite pleadings and a strong factual foundation.

Supreme Court’s Suo Motu on Non-Functional CCTV Cameras in Police Stations – A Timely Judicial Intervention

The Hon’ble Supreme Court of India, on 4th September 2025, under the bench of Justice Vikram Nath and Justice Sandeep Mehta, has rightly taken suo motu cognizance on the alarming issue of non-functional CCTV cameras in police stations across the country. This intervention was prompted by disturbing media reports that 11 custodial deaths have occurred within the last 7–8 months, exposing grave lapses in accountability and transparency within our law enforcement system.

It must be remembered that in Paramvir Singh Saini v. Baljit Singh (2020), the Supreme Court had categorically mandated the installation of functional CCTV cameras in all police stations and directed both State and Union Territory governments to ensure strict compliance. Sadly, even after nearly five years, compliance remains patchy, cameras lie defunct, and custodial deaths continue to stain the conscience of our democracy.

Highly Appreciable Observation by the Court:
The Hon’ble Bench observed that the persistence of custodial deaths, despite clear judicial directions, is a matter of serious constitutional concern, and that the very purpose of installing CCTV cameras—ensuring accountability, transparency, and the protection of fundamental rights—has been reduced to a mere formality in several states. The Court’s recognition of this grim reality and its decision to intervene suo motu reflect an unwavering judicial commitment to uphold Article 21 – Right to Life and Human Dignity.

Tribute to Senior Advocate Iqbal Chagla (1939 – 2025)
Mumbai, January 12, 2025 – The Indian legal fraternity has lost one of its most respected voices with the passing of Renowned Senior Advocate Iqbal Chagla, who breathed his last on 12 January 2025 at the age of 85. He had been unwell for some time. His funeral was held the following day at Worli Crematorium, Mumbai, in the presence of his family members and several distinguished members of the Bar.

Mr. Chagla, who began his practice in the 1960s, primarily before the Bombay High Court, carved a reputation for legal brilliance coupled with an unwavering commitment to ethics. He served as President of the Bombay Bar Association for three consecutive terms (1990–1999), and held important positions such as Member of the Executive Committee of the Bar Association of India and Member of the National Legal Services Authority, Delhi.

A fearless crusader against irregular practices, Mr. Chagla earned respect across the profession for speaking out against corruption and impropriety. His bold calls for judicial accountability at the Bombay High Court, including demanding the resignation of sitting judges, reflected his uncompromising integrity. In a remarkable act of humility, he declined the rare opportunity to be elevated directly to the Supreme Court of India from the Bar, choosing instead to continue his independent practice.

Tributes have poured in from across the country. Advocate Ashish Goel, practising before the Supreme Court of India, remarked:
“My memory of Iqbal Chagla has been and continues to be of an all-rounded person. I was enchanted by his simplicity. He was a great advocate who could turn a case around with great ease. He was a guide to young lawyers and the legal profession is much poorer by his demise.”

Aditya Bapat, Advocate at the Bombay High Court and co-founder of the Bombay Bar Association Podcast, fondly recalled his brief but memorable interaction with him:
“I only met Mr. Chagla once, at his apartment, for taping (for the podcast). Sometime later, he had graced an event at the Bar and he passed me as he walked to the front. Then he turned, looked back, smiled at me and said ‘hello’. It made my day.”

Adding his heartfelt respects, Dr. Anthony Raju, Advocate Supreme Court and Chairman of the All India Council of Human Rights, Liberties and Social Justice, said:
“The passing of Senior Advocate Iqbal Chagla is an irreparable loss to the Indian legal fraternity. He was not only a towering figure at the Bar but also a beacon of integrity, courage, and humility. His uncompromising stand against corruption and his role as a mentor to generations of young lawyers will continue to inspire the legal community for years to come. I extend my deepest condolences to his family, colleagues, and admirers. His legacy will remain eternal.”

Educated at Cambridge University, UK, and called to the Bar from Gray’s Inn, London, Mr. Chagla carried forward the illustrious legal legacy of the Chagla family with distinction. To generations of young advocates, he was not only a formidable lawyer but also a mentor and a role model who epitomized simplicity, grace, and professional ethics.

His demise marks the end of an era at the Bombay Bar, leaving behind a void that will be deeply felt by colleagues, juniors, and the judiciary alike.

लाखों निर्दोष विचाराधीन कैदी जेल में – जिम्मेदार कौन?

डॉ. एंथोनी राजू, अधिवक्ता सर्वोच्च न्यायालय एवं चेयरमैन – अखिल भारतीय मानवाधिकार, स्वतंत्रता एवं सामाजिक न्याय परिषद

भारत अपने संविधान और न्याय व्यवस्था पर गर्व करता है, लेकिन एक कड़वी सच्चाई यह है कि आज भी देश की जेलों में दो-तिहाई से अधिक कैदी विचाराधीन (Undertrial) हैं, जिनमें से बड़ी संख्या निर्दोष है। वे वर्षों से न्याय की प्रतीक्षा कर रहे हैं।

यह केवल एक कानूनी समस्या नहीं, बल्कि मानवाधिकारों का गंभीर हनन है और अनुच्छेद 21 के तहत गारंटीकृत जीवन और व्यक्तिगत स्वतंत्रता के अधिकार का सीधा उल्लंघन है।

जिम्मेदार कौन है?

1. पुलिस – अनावश्यक गिरफ्तारियाँ, कमजोर जाँच और समय पर चार्जशीट दाखिल न करना।

2. न्यायपालिका – जजों की कमी, तारीख़ पर तारीख़, जमानत सुनवाई में देरी।

3. अभियोजन (Prosecution) व राज्य – सबूत पेश करने में लापरवाही और जवाबदेही की कमी।

4. जेल प्रशासन – कैदियों को उनके अधिकारों और मुफ़्त विधिक सहायता के बारे में जानकारी न देना।

5. विधायिका (Legislature) – क़ानून में सुधार होने के बावजूद (जैसे धारा 436A दंप्रसं / धारा 479 BNSS 2023), इनका प्रभावी क्रियान्वयन न होना।

न्यायालय और मानवाधिकार का दृष्टिकोण

हुसैनआरा खातून बनाम बिहार राज्य (1979) – सुप्रीम कोर्ट ने त्वरित न्याय पाने का अधिकार अनुच्छेद 21 का हिस्सा माना।

अर्नेश कुमार बनाम बिहार राज्य (2014) – अनावश्यक गिरफ्तारी से बचने के स्पष्ट निर्देश दिए।

लेकिन हकीकत यह है कि निर्देश और फैसले काग़ज़ों में ही सीमित रह जाते हैं।

कठोर सच्चाई

ये विचाराधीन कैदी केवल आंकड़े नहीं हैं। ये हमारे मज़दूर, किसान, युवा और हाशिए पर खड़े नागरिक हैं जो गरीबी और अनभिज्ञता के कारण वकील तक नहीं कर पाते।

उनके लिए न्याय में देरी, न्याय से वंचित होना है।

आगे का रास्ता

“जेल नहीं, ज़मानत” सिद्धांत को लागू करना।

त्वरित न्यायालयों का गठन और केस मॉनिटरिंग व्यवस्था।

पुलिस और अभियोजन की जवाबदेही तय करना।

निःशुल्क विधिक सहायता की पहुँच हर कैदी तक सुनिश्चित करना।

अंतिम संदेश

जब लाखों निर्दोष नागरिक बिना दोष सिद्ध हुए जेलों में सड़ रहे हों, तो पूरा आपराधिक न्याय तंत्र दोषी है।

राज्य का यह संवैधानिक दायित्व है कि वह हर नागरिक की स्वतंत्रता और गरिमा की रक्षा करे।

यदि हम अब भी मौन रहे, तो यह केवल निर्दोषों की क़ैद नहीं होगी, बल्कि न्याय की आत्मा की क़ैद होगी।
