Highly Commendable Observation by Hon’ble Supreme Court: Dr. Anthony Raju, Advocate – Supreme Court & Chairman, Indian National Human Rights Protection Council
New Delhi, May 15, 2025 – Dr. Anthony Raju, a prominent Advocate of the Supreme Court and Chairman of the Indian National Human Rights Protection Council, has hailed the recent decision of the Hon’ble Supreme Court as “highly commendable and sensitive to the evolving nature of justice.”
This comes in the context of the Supreme Court’s order on Thursday, suspending the 10-year sentence of a man convicted of rape on the false promise of marriage, after both the man and the woman expressed their mutual willingness to marry each other.
Dr. Raju emphasized:
> “The Hon’ble Court’s observation reflects a pragmatic and humane approach to justice. It acknowledges the evolving nature of relationships and the importance of consent and mutual agreement. Such sensitivity, when balanced with judicial prudence, strengthens public trust in our legal system.”
Earlier, on September 5, 2024, the Jabalpur Bench of the Madhya Pradesh High Court had rejected the man's application under Section 389(1) CrPC for suspension of sentence, prompting him to approach the Supreme Court.
Dr. Raju added that the ruling sends a message that while the law must uphold accountability, it must also be responsive to the realities of human relationships, especially where both parties are consenting adults seeking a fresh beginning.

I highly commend the progressive and balanced observation made by the Hon’ble Supreme Court of India in granting relief to a man in a live-in relationship. The Court's recognition that “based on the length of such relationship and conduct of the parties, implied consent may be presumed” marks a forward-looking stance in protecting individual liberty and evolving societal norms.
This landmark observation acknowledges the reality of modern relationships and affirms the constitutional rights of consenting adults. It strengthens the jurisprudence around dignity, autonomy, and the right to choose one’s partner — without fear of legal persecution or societal stigma.
As an Advocate of the Supreme Court and Chairman of the Indian National Human Rights Protection Council, I strongly support the judiciary’s role in harmonizing traditional values with the dynamic realities of contemporary society.
