In a significant ruling safeguarding the independence and professional dignity of advocates, the Supreme Court of India has held that the mere presence of an advocate in a professional capacity for providing legal advice cannot amount to criminal intimidation.

The judgment was delivered by a Bench comprising Justice Aravind Kumar and Justice Prasanna B. Varale while allowing an appeal filed by an advocate who had been implicated on allegations of criminal intimidation.

The Supreme Court categorically observed that an advocate, while discharging legitimate professional duties such as giving legal advice or being present with a client, cannot be prosecuted for criminal intimidation unless there is clear and cogent evidence indicating an intention to cause alarm.

The Court reiterated that criminal intimidation under Section 506 of the Indian Penal Code requires a specific intent. Mere words, professional advice, or presence without such intent do not satisfy the ingredients of the offence.

The Bench also took note of serious inconsistencies in the complainant’s statements, observing that allegations of threat were not mentioned in the initial statement and surfaced only after a delay, thereby weakening the prosecution case.

The complainant had alleged that the advocate intimidated her during the course of legal interaction. However, upon examining the record, the Supreme Court found that the initial police statement did not contain any allegation of threat and that the subsequent accusations were vague, delayed, and unsupported by material evidence.

Allowing the appeal, the Supreme Court quashed the criminal proceedings against the advocate, holding that the professional conduct of a lawyer cannot be criminalised on the basis of vague, inconsistent, or unsubstantiated allegations.
