<p>SECTION 18 OF THE SC/ST ACT – COMPLETE LEGAL OVERVIEW</p>
<p></p>
<p>The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is a stringent special legislation enacted to protect members of Scheduled Castes and Scheduled Tribes from atrocities, humiliation, exploitation, discrimination, and caste-based violence.</p>
<p>Section 18 of the SC/ST Act is one of the most important and heavily litigated provisions under the Act.</p>
<p>SECTION 18 SC/ST ACT क्या है?</p>
<p>Section 18 यह प्रावधान करता है कि सामान्यतः Section 438 CrPC / संबंधित BNSS provisions के अंतर्गत मिलने वाली anticipatory bail (अग्रिम जमानत) SC/ST Act के मामलों में लागू नहीं होगी, यदि prima facie अपराध बनता हो।</p>
<p>सरल शब्दों में:</p>
<p>यदि FIR और आरोपों से प्रथम दृष्टया SC/ST Act का अपराध बनता दिखाई देता है, तो anticipatory bail पर रोक लग सकती है।</p>
<p>SECTION 18 की कानूनी व्याख्या</p>
<p>Section 18 एक statutory restriction provision है जो anticipatory bail पर प्रतिबंध लगाता है जहाँ SC/ST Act के अपराध prima facie दिखाई देते हों।</p>
<p>हालांकि, Supreme Court of India तथा विभिन्न High Courts ने बार-बार यह स्पष्ट किया है कि:</p>
<p>यदि FIR या शिकायत से prima facie SC/ST offence नहीं बनता, तो anticipatory bail दी जा सकती है।</p>
<p>SECTION 18 के अंतर्गत सज़ा</p>
<p>महत्वपूर्ण बात:</p>
<p>Section 18 स्वयं कोई अलग सज़ा निर्धारित नहीं करता।</p>
<p>यह केवल anticipatory bail पर procedural restriction लगाने वाला प्रावधान है।</p>
<p>सज़ा उस विशेष offence पर निर्भर करेगी जो SC/ST Act तथा अन्य संबंधित धाराओं के अंतर्गत लगाया गया है।</p>
<p>आरोपों के अनुसार सज़ा हो सकती है:</p>
<p>6 महीने से लेकर</p>
<p>आजीवन कारावास (Life Imprisonment)</p>
<p>साथ में जुर्माना</p>
<p>क्या अपराध BAILABLE है या NON-BAILABLE?</p>
<p>SC/ST Act के अधिकांश गंभीर अपराध:</p>
<p>Non-Bailable</p>
<p>Cognizable</p>
<p>होते हैं।</p>
<p>पुलिस को गिरफ्तारी की शक्ति होती है, किन्तु यह संवैधानिक सुरक्षा एवं न्यायिक निगरानी के अधीन होती है।</p>
<p>क्या ANTICIPATORY BAIL मिल सकती है?</p>
<p>हाँ — उचित मामलों में मिल सकती है।</p>
<p>यद्यपि Section 18 anticipatory bail पर प्रतिबंध लगाता है, फिर भी अदालतें anticipatory bail प्रदान कर सकती हैं यदि:</p>
<p>Prima facie SC/ST offence नहीं बनता</p>
<p>झूठी फँसाने की संभावना दिखाई देती हो</p>
<p>Caste-based intention अनुपस्थित हो</p>
<p>Civil, matrimonial, political या personal dispute को criminal case बना दिया गया हो</p>
<p>FIR में गंभीर contradictions हों</p>
<p>FIR में असामान्य delay हो</p>
<p>Offence के आवश्यक ingredients पूरे न होते हों</p>
<p>Supreme Court of India तथा विभिन्न High Courts ने genuine victims की सुरक्षा के साथ-साथ निर्दोष व्यक्तियों को false implication से बचाने पर भी बल दिया है।</p>
<p>SC/ST ACT CASE में BEST DEFENCE STRATEGY</p>
<p>1. “PRIMA FACIE CASE” को चुनौती दें</p>
<p>सबसे महत्वपूर्ण defence strategy यह सिद्ध करना है कि FIR alleged offence के आवश्यक कानूनी ingredients पूरे नहीं करती।</p>
<p>सिर्फ caste का उल्लेख कर देना पर्याप्त नहीं है।</p>
<p>Defence को जांचना चाहिए:</p>
<p>Intent</p>
<p>Public view requirement</p>
<p>Specific allegations</p>
<p>Independent witnesses</p>
<p>Delay एवं contradictions</p>
<p>2. FALSE IMPLICATION एवं MALAFIDE को उजागर करें</p>
<p>कई मामलों में SC/ST provisions जोड़े जाते हैं:</p>
<p>Personal rivalry</p>
<p>Property disputes</p>
<p>Relationship disputes</p>
<p>Employment conflicts</p>
<p>Political pressure</p>
<p>Family enmity</p>
<p>के कारण।</p>
<p>ऐसे मामलों में documentary और digital evidence अत्यंत महत्वपूर्ण हो जाते हैं।</p>
<p>3. DIGITAL EVIDENCE का आक्रामक उपयोग करें</p>
<p>मजबूत defence evidence में शामिल हो सकते हैं:</p>
<p>WhatsApp chats</p>
<p>Call recordings</p>
<p>Location records</p>
<p>Travel documents</p>
<p>Photos एवं videos</p>
<p>Social media communications</p>
<p>Prior friendly relations</p>
<p>Marriage discussions या applications</p>
<p>ये साक्ष्य कई बार false allegations को पूरी तरह कमजोर कर देते हैं।</p>
<p>4. COMPLAINANT के CONDUCT पर ध्यान दें</p>
<p>Courts निम्न बातों को गंभीरता से देखते हैं:</p>
<p>FIR में delay</p>
<p>Continued communication</p>
<p>Contradictory behaviour</p>
<p>Facts suppression</p>
<p>Previous disputes</p>
<p>यह anticipatory bail hearing में अत्यंत महत्वपूर्ण होता है।</p>
<p>5. “NO CUSTODIAL INTERROGATION REQUIRED” पर ज़ोर दें</p>
<p>यदि charge sheet दाखिल हो चुकी हो:</p>
<p>Investigation substantially complete होती है</p>
<p>Recovery pending नहीं होती</p>
<p>Custody की आवश्यकता कम हो जाती है</p>
<p>यह regular bail एवं anticipatory bail दोनों में मजबूत ground बनता है।</p>
<p>6. ABSOLUTE DISCIPLINE बनाए रखें</p>
<p>Accused को चाहिए कि:</p>
<p>Complainant से संपर्क न करे</p>
<p>Social media discussion से बचे</p>
<p>हर hearing attend करे</p>
<p>Bail conditions का पूर्ण पालन करे</p>
<p>किसी भी violation से bail cancellation हो सकती है।</p>
<p>LIABILITY OF INVESTIGATING OFFICER IN FALSE SC/ST CASES</p>
<p>यदि यह सिद्ध होता है कि:</p>
<p>जानबूझकर झूठी FIR बनाई गई,</p>
<p>गलत धाराएँ लगाई गईं,</p>
<p>निष्पक्ष जांच नहीं हुई,</p>
<p>या mala fide intention से कार्रवाई की गई,</p>
<p>तो Investigating Officer के विरुद्ध:</p>

<description><![CDATA[<p>Judiciary must remain above suspicion not just in truth but in perception</p>
<p>Senior Advocate Prashant Bhushan has articulated what many in the legal fraternity have long felt but hesitated to state openly.</p>
<p>The nomination of former Chief Justice Ranjan Gogoi to the Rajya Sabha immediately after delivering some of the most politically sensitive judgments, including the Ayodhya verdict and the Rafale deal case, has created a serious perception crisis.</p>
<p>Let me be absolutely clear. Justice must not only be done, but must be seen to be done. Even the slightest appearance of post retirement inducement strikes at the root of judicial credibility.</p>
<p>This is not about targeting an individual. It is about protecting the institution of the judiciary from erosion of public trust.</p>
<p>If judges, particularly at the highest level, accept positions from the executive soon after retirement, it raises unavoidable and legitimate questions. Was there complete institutional independence. Or does the system risk appearing compromised.</p>
